New Bill Requires Federal Agents Alert Local Sheriff Before They Act

A new bill in the Idaho Senate would give property owners more privacy from the government.

Senate Bill 1326 is called the “Property Rights Protection Act” and amends Idaho code to further protect from warrantless searches. It would require government agents to stay on only the property open to the public unless they have a valid search warrant. Open property is defined as a “…driveway, walkway, or similar pathway.”

The bill would also require federal agents to notify the local sheriff before they act. It does leave a door open though in the words “…unless exigent circumstances require”.

Under the new rules, government agents will be required to “promptly leave… upon the request of the owner or occupant, unless otherwise authorized by law to remain.

The law applies to be owners and the people leasing a property. If it’s passed and the Governor signs it, it will go into effect immediately.
