UPDATE FROM WINDOW ON THE CLEARWATER:
McMillen is charged with two counts of felony Aggravated Assault, felony Possession of a Controlled Substance, felony Possession of a Firearm by a Convicted Felon and two misdemeanors, Use or Possession of Drug Paraphernalia and Possession of Marijuana, according to iCourt Idaho records.
Umphenour is charged with two counts of felony Aggravated Assault, felony Possession of a Controlled Substance and two misdemeanors, Possession of a Controlled Substance Marijuana and Possession of Drug Paraphernalia, according to iCourt Idaho records.
Both men made their first appearance on the charges Tuesday before Magistrate Judge David Judd. Their preliminary hearings have been scheduled for Dec. 5, iCourt says. They remain in custody according to Vinelink Idaho.
According to Probable Cause documents, the charges stem from an incident in the area of Lacy Meadows Rd. that was reported to Clearwater County Dispatch about 5:50 p.m. Monday as a two-vehicle accident with shots fired.
The reporting party told law enforcement that they observed a white Ford pickup whose occupants appeared to be spotlighting. The passenger with the reporting party was attempting to get a photo of the license number so it could be reported. At that point in time, the driver of the pickup slammed on his brakes causing the second vehicle to slam into the back. They said they continued to follow the Ford and the pickup then stopped, reversed and slammed into them. The reporting driver continued to follow the Ford into town to get them in trouble for spotlighting and the crashes. Then the passenger in the Ford spotlighted and shot at them. Both men in the second vehicle told a deputy that being rammed by the Ford and being shot at by the passenger caused them to fear for their lives, the documents said.
According to the Probable Cause documents, a deputy that was familiar with the vehicle and possible occupants was able to find and stop the Ford, and with the assistance of three other deputies, Umphenour and McMillen were detained for the earlier incident. After consultation with the prosecuting attorney, the decision was made to arrest Umphenour and McMillen on charges of Aggravated Assault. In a search of the men and the vehicle, the controlled substances and paraphernalia were found and inventoried as evidence. A shell casing and other ammunition were also found. The pickup was searched per the vehicle exception for narcotics. After the search, inventory and evidence collection from the vehicle, Jacksons Towing took possession of the pickup.
