Judge to consider additional evidence in Lewiston murder trial

Nez Perce County District Judge Jay Gaskill will consider additional evidence presented Friday by Nez Perce County prosecutors in the first-degree murder trial of Clyde Ewing and his 17-year-old son, Demetri Ewing.

Nez Perce County Prosecutors submitted evidence, including video and audio files and testimony from alleged witnesses regarding the shooting of Samuel Johns on Jan. 8th, 2021.

Defense attorneys for both defendants objected to the evidence. They argued against submitting the video and audio evidence that was not the original footage. Prosecutors argued the video and audio evidence doesn’t add or take away from the raw footage.

Defense attorneys also objected to testimony from witnesses including Clyde Ewing’s sister and the siblings of the victim, Samuel Johns regarding incidents of vandalism and the search for a missing Army bag as hearsay. Investors allege that a dispute over a stolen bag and gun may be what led to the shooting.

After nearly two and a half hours of testimony and arguments from attorneys, Gaskill recessed to consider motions for evidence. (Lewiston Tribune)
