Until yesterday, it wasn’t legal to speed up to pass someone on a highway passing lane in Idaho. House Bill 205 changed that. It’s now legal to go up to 15 miles per hour over the speed limit while you’re passing.
Some of the rules attached include: The person you’re passing must be going under the speed limit, you can not be towing anything, it can not be in a city or a highway with a speed limit less than 55 miles per hour. It also only applies to cars, pickups, and motorcycles. It does not list tractor-trailer trucks or logging trucks.
A passing lane is defined as a widening of the highway to provide another lane for vehicles to overtake slower-moving vehicles going in the same direction.
