Washington High Capacity Magazine Ban to Remain in Effect While Challenge Decided

A Washington state Supreme Court commissioner has ordered the state’s high-capacity magazine ban remain in effect while a legal challenge against it makes its way through the court system.

The high-capacity magazine ban was first overturned briefly by a Cowlitz County judge who ruled the law itself was unconstitutional, and imposed an injunction on it for a short time. Less than two hours later, a judge granted the Washington State Attorney General’s Office a temporary stay on that injunction, and the high-capacity magazine ban went back into effect.

Yesterday’s (Thurs) decision from state Supreme Court Commissioner Michael Johnston kept the stay in place, and it will remain so while the legal challenges against the high-capacity magazine ban are being decided.

Washington’s ban on high-capacity magazines first went into effect on July 1, 2022. The ban prohibits the sale of gun magazines with a capacity of more than 10 rounds, along with the manufacturing, distribution or import of high-capacity magazines in Washington state.
