Judge Denies Kohberger Defense Motion to Pause Case

Idaho District Judge John Judge has denied a motion to pause the case against quadruple murder suspect Bryan Kohberger.

According to KHQ, court documents show the request was denied because it was too premature. The court, Kohberger and his counsel agreed that pausing the case would allow his defense team enough time to review grand jury records. Then, his team will decide if they want to file another motion to put the trial on hold.

On July 17, the state filed a motion to reconsider the order staying time for a speedy trial. On July 25, Kohberger’s attorneys filed a second motion arguing that only 32 jurors appeared in court when 45 should have been present. The defense also claims there were inconsistencies in the juror questionnaire forms and issues with questions answered by two potential jurors.

The court denied the request and said, the issues raised in Kohberger’s Second Motion to Stay Proceedings do not constitute substantial failure to comply with the procedures for selecting a grand jury.

Kohberger’s defense team now has just over a month to obtain and review the grand jury records, then, they can determine if they want to renew the motion to stay proceedings.

Kohberger is accused of murdering four University of Idaho Students in November last year.
