von Ehlinger seeks acquittal or new trial

Former Lewiston state lawmaker Aaron von Ehlinger, who was convicted of rape last month, has requested a new trial on the basis of insufficient evidence.

Von Ehlinger was convicted April 29th of raping a 19-year-old Statehouse intern after a jury found him guilty on a felony count of rape, and not guilty on a felony count of forcible penetration with a foreign object. A sentencing date of July 28th was set following von Ehlinger’s conviction.

The Lewiston Tribune reports, von Ehlinger and his attorney are seeking an acquittal, or a new trial, saying there was insufficient evidence to convict the former Idaho House member.

The motion, filed May 13th, also says the defense anticipates presentation of new evidence during a hearing for a new trial, which is set for June 13th. Additionally, the defense filed a separate motion for von Ehlinger to be released pending the new proceedings with a set bond. (Lewiston Tribune)
