Former Pullman police officer’s case ends in mistrial

A mistrial has been declared in the custodial sexual misconduct trial of a former Pullman Police Officer.

Whitman County Superior Court Judge Gary Libey on Thursday evening declared the mistrial after the 12-member jury could not reach a consensus in the case against former sergeant Dan Hargraves.

Hargraves was charged after an 18-year-old Washington State University student alleged he sexually assaulted her while she was intoxicated and in his custody in March 2018.  Hargraves, a 19-year-veteran of the department, denied the allegations in his trial testimony Wednesday.

His trial took nearly two weeks as the jury was presented with substantial evidence from the prosecutor and the defense attorney, including phone records, police body camera footage, and testimonies from forensic experts.

The jury deliberated Wednesday afternoon and all of Thursday, but could not reach a verdict. Whitman County Prosecutor Denis Tracy says the hung jury means his office will have to consider whether to try Hargraves again. (Lewiston Tribune)
