Judge to rule on several motions prior to Lewiston murder trial

Several motions have been made prior to a Lewiston murder trial set to begin next week.

Nez Perce County 2nd District Judge Jeff Brudie on Tuesday took several motions under advisement in the case of trial of 56-year-old Patrick Nuxoll, who’s accused of fatally stabbing and slashing David Cramer at Nuxoll’s Lewiston home in May 2015. Nuxoll’s first-degree murder trial is scheduled to begin Monday in Moscow after attempts to seat an unbiased jury in Lewiston failed.

Prosecutors had filed several motions, one concerning introducing taped statements from a now-deceased woman who spoke with detectives by phone about a call she received from Nuxoll the night of the homicide. Nuxoll’s attorney objected to the motion, saying since the witness is deceased, the defense has no ability to confront her testimony.

Other motions included the state asking to include the criminal history from a defense witness, and to include character evidence showing Nuxoll had a “propensity” to kill. The judge is expected to rule on the motions in the next few days.  (Lewiston Tribune)
